The music industry has a secret. And according to a Rolling Stone investigation, nearly everyone in it knows — they just don't talk about it.
AI is now pervasive in music production. Not as a novelty, not in a few experimental tracks: as a routine production tool across genres. And the culture around it, songwriter Michelle Lewis told Rolling Stone, is essentially don't ask, don't tell.
The Hip-Hop Sample Economy Has Shifted
The most concrete data point comes from producer Young Guru, who has worked with Jay-Z, Beyoncé, and others over a career spanning three decades. His estimate: more than half of sample-based hip-hop is now made using AI-generated funk and soul samples, rather than licensed original recordings.
That's a remarkable claim — and a structurally significant one. The classic hip-hop production workflow involved flipping samples from vinyl: an old James Brown record, a 1970s soul break, a jazz chord sequence. Licensing those samples required identifying the original recording, tracking down rights holders, and paying fees that could run from a few thousand to hundreds of thousands of dollars, plus royalty percentages of future revenue.
AI generation sidesteps all of that. A producer can describe a groove, generate a funk sample that sounds like it could have been from 1974, and use it — no clearance, no negotiation, no percentage. The output sounds credible. The cost is minimal. The legal exposure is murky but, so far, largely untested at this specific level.
A "Don't Ask, Don't Tell" Industry
The Lewis quote to Rolling Stone is telling: AI use is "common" across genres, but "nobody wants to admit it." The reasons aren't hard to understand. For major-label artists, admitting AI involvement risks fan backlash and label friction. For independent producers, it risks being seen as cutting corners. For everyone, it raises legal questions that nobody has fully resolved.
But the practice is spreading anyway. Producers are using AI to create sample material, experiment with arrangements, and demo songs. The sonic results, at least from AI tools trained on enough music, are good enough that detection is difficult without explicit disclosure.
This isn't limited to hip-hop. Artists across genres are quietly incorporating AI tools into their workflows. The country music scene adopted AI earlier and more visibly than most — but Rolling Stone's investigation suggests country was just the visible tip of a much broader practice.
The Legal Grey Zone
The core legal question — whether AI-generated music that mimics a style (rather than copying a specific recording) violates copyright — remains unresolved. Style itself is not copyrightable. A groove that sounds like James Brown is not a copy of a James Brown record.
But the AI models generating that groove were trained on actual recordings, potentially including copyrighted material used without license. Several major lawsuits — from record labels against AI music companies — are working through courts on exactly this question. The outcomes will shape whether the current don't-ask-don't-tell era in music production becomes normalized or triggers a legal reckoning.
For now, the practice is ahead of the law. Producers are making music. Nobody's asking. Nobody's telling. And the economics are compelling enough that the trend is unlikely to reverse regardless of how the legal questions ultimately settle.
